Claims Against the Town
Before You Submit a Claim
We understand that damage or sustaining an injury can be stressful. Please note that the Town of Saugeen Shores is not your insurer and submitting a claim does not guarantee compensation. You must show that the damage was caused by the Town’s negligence.
If you have auto or property insurance, we recommend contacting your insurer first. They may offer broader coverage and, if they believe the Town is responsible, they may pursue a claim on your behalf.
About Negligence
The Town is responsible for maintaining infrastructure to a reasonable standard. Negligence means the Town failed to meet that standard, directly causing damage or injury.
Submitting a Claim
If you decide to file a claim, clearly explain why you believe the Town is responsible and include evidence of your damages.
What will happen after you submit a claim?

Once the form has been submitted you will be emailed an electronic copy of the form for your records. Within five (5) business days you will receive a response from the appropriate staff member responsible for the claim.

The Town will investigate to determine if it met its maintenance obligations. If you cannot establish that your damages were caused by the Town’s negligence, the Town will not pay your claim.

If the Town did not exercise a reasonable standard of care, the Town may be found to be negligent. In that circumstance, the Town will attempt to resolve your claim. Any compensation paid to you will be based on proof of damage that has arisen as a result of the Town’s negligence.

If the Town did exercise a reasonable standard of care, your claim will be denied.
